Parking Facility Permit Lease Agreement

This lease is entered into between the Parking Authority of the City of Lancaster, Pennsylvania (“Lancaster Parking Authority” or “Lessor”), organized and existing under the laws of the Commonwealth of Pennsylvania, and the permit holder (“Lessee”).

Terms and Conditions

1. Premises

Lessor leases to Lessee the number of assigned paid parking permit spaces (“Leased Premises”) located at the assigned parking facility in Lancaster, Pennsylvania (“Parking Facility”).

2. Term

This lease shall commence on the date of sign-up and may automatically continue on a month-to-month basis. Any request to cancel must be submitted in writing and received by the Lancaster Parking Authority before the end of the month.

3. Rent

Lessee shall pay the posted rate per parking space. Payments are due on the first day of each month.

A late payment penalty of $25.00 per parker shall be assessed for any amount not paid by midnight on the tenth (10th) day of the month in which payment is due.

If the lease is cancelled during the month, no refund of partial month’s rent will be issued. Parking usage without use of an approved access credential remains the responsibility of the Lessee and will not be refunded.

4. No Assignment or Sublease

Lessee shall not assign, transfer, or sublease this lease to any third party.

5. Use of Parking Facility

Lessee shall use, or permit use of, the leased premises only for the parking of currently licensed and registered vehicles.

The leased premises shall not be used for any purpose including, but not limited to:

• Sale of merchandise
• Display of merchandise
• Storage of merchandise
• Storage of vehicles
• Vehicle servicing or repair activities

Parking shall remain subject to all Lancaster Parking Authority rules and regulations.

Lessee must use an approved Lancaster Parking Authority access credential, including License Plate Recognition (LPR), a QR Code credential, a white access card, or another authorized access method, to enter and exit the parking facility.

6. Risk of Loss

Lessor assumes no responsibility for vehicles or their contents parked within the Parking Facility or upon the leased premises.

7. Default

Lessee shall be in default if:

• Monthly fees or other required charges are not paid within ten (10) days after the due date; or
• Lessee fails to comply with any provision of this lease.

Upon default, Lessor shall not be required to provide notice and may immediately declare the lease in default.

8. Lessor’s Remedies

Upon default by Lessee, and in addition to any remedies provided by law, Lessor may exercise any or all of the following rights:

• Terminate the lease.
• Require immediate surrender of any access credentials issued by the Lancaster Parking Authority.
• Declare unpaid lease obligations immediately due and payable using the then-current advertised rate.
• Pursue legal action for unpaid rent, fees, costs, and reasonable attorney fees.

Lessee waives any right to notice under the Landlord and Tenant Act of 1951 to the extent permitted by law.

9. Entire Agreement

This lease constitutes the entire agreement between the parties. No oral or written agreements exist except as expressly stated herein.

This lease may only be amended in writing and signed by both parties.

This agreement shall be governed and interpreted under the laws of the Commonwealth of Pennsylvania.
